మొన్న అక్టోబర్ ఆరో తేదీన ఆంధ్ర ప్రదేశ్ ముఖ్యమంత్రి వైఎస్ జగన్మోహన్ రెడ్డి సుప్రీంకోర్టు న్యాయమూర్తి జస్టిస్ ఎన్ వి రమణమీద ప్రధాన న్యాయమూర్తికి ఫిర్యాదు చేసిసంచలనం సృష్టించారు. సుప్రీంకోర్టు న్యాయమూర్తుల మీద ఏదో ఒక ఫిర్యాదు రావడం కొత్త కాదు. అయితే, ఒక రాష్ట్ర ముఖ్యమంత్రి ఈ ఫిర్యాదు చేయడం, దాని మీద నేరుగా ఆయన ప్రధాన న్యాయమూర్తికి ఏకంగా ఫిర్యాదు పంపించడం జరిగింది. దానికి తో డు ఫిర్యాదు లేఖను పత్రికలకు విడుదల చేసి తన ఫిర్యాదు ఏమిటో జగన్ ప్రజలందరికి తెలిసేలా చేశారు.
ఇది పెద్ద దూమారం లేపింది. టివిల్లోె పత్రికల్లో సోషల్ మీడియాలో పెద్ద చర్చ కట్లు తెంచుకుని సాగుతూ ఉంది. ఎన్నికోణాల్లో దీనిని విశ్లేషిస్తున్నారో లెక్కేలేదు.అన్ని కోణాలు వచ్చాయి. కొత్త కోణాలు బయటపడుతున్నాయి. ఇది రెడ్డి వర్సెస్ కమ్మ క్యాస్ట్ వార్ అని కొందరంటే ఒక పేరున్న వెబ్ సైట్ దీనిని గ్యాంగ్ వార్ అని వర్ణించింది. జగన్ వర్సెస్ చంద్రబాబునాయుడు క్యాస్ట్ వైరుధ్యం వార్ ఇలా జ్యుడిషియరీలోకి కరోనాలా వ్యాప్తి చెందిందని కొందరంటున్నారు. మొత్తానికి జస్టిస్ రమణ పేరు, ఆయన కుటుంబ సభ్యుల పేర్లు, వారు కొన్న భూముల వివరాలు, సుప్రీకోర్టులో నెంబర్ టూ గా ఉన్న జస్టిస్ రమణ ఆంధ్రప్రదేశ్ హైకోర్టులోని కొందరు న్యాయమూర్తులను ప్రభావితం చేస్తున్నారని జగన్ లేఖ వల్ల నలుగురికీ తెలిసింది. నిజానికి ఇదంతగా చాలా మంది మనుసుల్లో ఉన్నమాటే తప్ప కొత్త దేమీకాదు. కాకపోతే, తొలిసారి ఇది ఒక ముఖ్యమంత్రి నోట రావడం, అది కూడాసుప్రీంకోర్టు ప్రధాన న్యాయమూర్తికి ఫిర్యాదుగా బయటకురావడమే కొత్త.
ఇలా ఒక ఆంధ్రప్రదేశ్ చీఫ్ మినిష్టర్ న్యాయవ్యవస్థ మీద తిరుగుబాటు చేయడం ఇది కొత్త కాదు. జగన్ లేఖ రెండో లేఖ. మొదటి లేఖను నాటి ముఖ్యమంత్రి దామోదరం సంజీవయ్య రాశారు. ఆలేఖని 4.11.1961లో ముఖ్యమంత్రి సంజీవయ్య నాటి హోమ్ మంత్రి లాల్ బహదూర్ శాస్త్రికిి రాశారు.
కాకపోతే, ఈ లేఖని నాటి ఆంధ్రప్రదేశ్ ప్రధాన న్యాయమూర్తి జస్టిస్ పి చంద్రారెడ్డి కి వ్యతిరేకంగా రాశారు. ఆయనను బదిలీచేయాలని సంజీవయ్య డిమాండ్ చేశారు.
ప్రధాన న్యాయమూర్తి జస్టిస్ పి చంద్రరెడ్డికి కులాభిమానం ఉందని, ఆయనకు బలమయినఇష్టాయిష్టాలున్నాయని అదంతా ఆయన పని తీరులో ప్రత్యక్షమవుతున్నదని సంజీవయ్య ఆరోపించారు. ఈ కారణాల వల్ల ఆయనను ఆంధ్రప్రదేశ్ హైకోర్టు నుంచి బదిలీ చేయాలని ముఖ్యమంత్రి సంజీవయ్య కేంద్రహోం మంత్రిగా ఉన్న శాస్త్రీజీకి రాసిన ఏడుపేజీల లేఖలో పేర్కొన్నారు..
Mr. P Chandra Reddy is thoroughly communal minded and he displays the quality openly without any regard to public opinion. He has strong likes and dislikes which badly interfere with his work.
He got closely attached to some puisne judges of the High Court who have been exercising strong influence over him, namely Justice P. Satyanarayana Raju and Mr. Justice Jaganmohan Reddi.
The entire administration is run by them. The former of the two, particularly, is of very scheming and intriguing type and Mr. Justice Chandra Reddy is completely in his hands.
They go to the High Court together every day and even in the open parties in the public, this association is demonstrated much to the chagrin of their other colleagues who have insignificant existence in the High Court.
Except for two or three judges, the rest are not all independent, and they can be said to be “Yes Men” of Mr. Chandra Reddy, Mr. Raju, or Mr. Jaganmohan Reddi.
Only such people are chosen for Bench and the Full Benches of our High Court and have become a farce and a mockery.
The senior-most Judge next to the chief justice, Mr.Justice Umamaheswaran, who is an independent and sometimes insulted in a sly fashion by keeping Mr. Justice Satyanarayana Raju in charge of the work of the chief justice in his absence.
Such personal considerations are not conducive to the harmony or reputation of the High Court. I understand that important files are not even circulated to Mr Justice Umamaheswaran or some other senior Judges.I learn that there is also manipulation in their posting of cases before the Judges.
It came to my notice now that Sri E. Venkatesam, though he is an average type of lawyer, has been recommended by the Chief Justice for appointment as High Court Judge, because he was a junior under Justice P Satyanayarayana Raju when he was an advocate and because Mr. Justice Raju influences the chief justice.
The Bar has a grievance against this. Mr. Justice Raju got Ramachandra Raju, another ex-junior of his, appointed as a directly-recruited District Judge and got him almost immediately posted to Visakhapatnam which is a coveted place by disturbing a more senior Judge.
Mr. Chandrasekhar Reddi who was also recruited directly as a District Judge at the same time was posted to Chittoor, another coveted station, by disturbing another senior Judge there. It is unfortunate that these things were done on personal consideration which demoralizes the Judicial service.
లేఖలో సీనియారిటీలో నెంబర్ 2 అయిన జస్టిస్ ఉమమహేశ్వరన్ ను జస్టిస్ చంద్రారెడ్డి నిర్లక్ష్యం చేయడమే కాదు, ఆయన్ని అవమాన పరుస్తున్నారని కూడా సంజీవయ్య రాశారు.
ఈ జస్టిస్ ఉమామహేశ్వరన్ ఎవరనుకున్నారు? మాజీ ముఖ్యమంత్రి కోట్ల విజయభాస్కర్ రెడ్డి కి సీనియర్. మద్రాసులో లా పూర్తి చేశాక, కోట్ల కొద్ది రోజులు ఆయన దగ్గిర జూనియర్ గా పనిచేశారు.
అంతేకాదు, సుప్రీంకోర్టు నాటి న్యాయమూర్తి జస్టిస్ కుప్పుస్వామి అయ్యర్ బావమర్ది కమ్ అల్లుడు. కుప్పు స్వామి ప్రఖ్యాత న్యాయవాది,మాజీ రాజ్యసభ సభ్యుడు అల్లాడి కృష్ణ స్వామి కుమారుడు
ఉమమహేశ్వరన్ కు బాగా మంచిపేరుంది. అలాంటి వ్యక్తిని ప్రధాన న్యాయమూర్తి చంద్రారెడ్డి పక్కన పెట్టి తాను లేనపుడు ప్రధాన న్యాయమూర్తి బాధ్యతలను జూనియర్ లకు ఇస్తున్నారని ముఖ్యమంత్రి పేర్కొన్నారు. జస్టిస్ ఉమమహేశ్వరన్ హైదరాబాద్ లో నే రిటైర్ అయ్యారు.
నాటి ప్రధాన న్యాయమూర్తి చంద్రారరెడ్డి జస్టిస్ సత్యనారాయణ రాజు,జస్టిస్ జగన్మోహన్ రెడ్డి వంటి వారిని ప్రోత్సహిస్తున్నారని కూడా ముఖ్యమంత్రి ఆరోపించారు.
అంతేకాదు, జస్టిస్ జగన్మోహన్ రెడ్డి తనకు ఇష్టమయిన వాళ్లను జిల్లా జడ్డిలుగా నియమించి, వాళ్లని కొత్తలోనే విశాఖ పట్టణం వంటి కీలకమయిన జిల్లాలలో నియమిస్తున్నారని, ఇది భావ్యం కాదని స్వయాన ముఖ్యమంత్రి కేంద్రానికి ఫిర్యాదు చేశారు.
ప్రధాన న్యాయమూర్తి జస్టిస్ చంద్రారెడ్డి, న్యాయమూర్తి జస్టిస్ సత్యనారాయణ రాజు తమకు ఇష్టమయిన జిల్లా జడ్జిలను ఎలా ప్రమోట్ చేస్తున్నారో కూడా ముఖ్యమంత్రి సంజీవయ్య లేఖలో పేర్కొన్నారు.
ఈ బంధుప్రీతి వల్ల రాష్ట్ర హైకోర్టు న్యాయ వ్యవస్థ కుళ్లి కంపుకొడుతున్నదని, సంపూర్ణ ప్రక్షాళన అసవరమని ముఖ్యమంత్రి ఘాటైన విమర్శ చేశారు. ఇలా సిటీకి చెందిన ఓబుల్ రెడ్డి అనే జిల్లా జడ్జికి ప్రధాన న్యాయమూర్తి ఎంత ప్రాముఖ్యమిచ్చారో ఆయన లేఖలో ఇలా వివరించారు.
“It is a matter of public knowledge that Sri S. Obul Reddi, a district Judge in this city, goes to the Chief Justice very frequently and creates an impression to others that he is all in all with him. The Chief Justice singles out and for every function either in the High Court or at his residence invites only Mr Obul Reddy and no other District Judge in the City. Mr. Obul Reddy is a strong favourite of Mr. Justice Raju and every morning and evening he goes to the his house. It is surprising that how these things are allowed and they give a very bad impression to others. In short the whole atmosphere is stiయking and requires radical toning upin the interest of the people of this state.
